Through our combined private practice and government experience, we have gained significant expertise in drafting winning appellate briefs and presenting compelling oral arguments. Our appellate experience includes successfully litigating appeals before the Federal Circuit and Ninth Circuit, among others. In particular, Nancy has argued before the Ninth Circuit court of appeals over twenty times and argued before the Nevada Supreme Court en banc in a certified question case. As a federal prosecutor—appearing variously as appellant and appellee—she authored over four dozen briefs in matters ranging from complex fraud, to opioid trafficking, to first-impression questions of statutory interpretation. At DOJ, she was the go-to attorney for presenting oral argument when the briefing attorney became unavailable. She also has significant experience preparing colleagues for court arguments and jury presentations, including trial opening statements and closing arguments, and provides invaluable contributions to trial teams who want to preserve the record for appeal. Additionally, we have experience drafting amicus briefs before circuit courts of appeals and the U.S. Supreme Court, as well as emergency appellate motions.
